Terms of Service

NetNavi and NetNavi Cloud are trading names of Omtrex Ltd (company number 13851032). Your contract for NetNavi Cloud services is with Omtrex Ltd unless a separate written agreement states otherwise. These terms apply to NetNavi Cloud web hosting, DNS hosting and related services unless a separate written agreement says otherwise. Our Acceptable Use Policy forms part of these terms.
1. Orders and accounts
You must provide accurate account and contact information and keep it up to date. You are responsible for activity carried out using your account and for protecting passwords, API credentials and other access details.
We may reject or review an order where reasonably necessary for fraud prevention, security, service availability or compliance reasons.
2. Services
We will provide the service described in the applicable plan or order. Features, limits, storage, bandwidth, DNS-zone allowances and other resources may vary by plan and will be shown in the service description or Client Area.
We may make reasonable technical changes where required to maintain security, reliability, compatibility or service quality, provided those changes do not materially remove the core service you purchased without reasonable notice.
3. Charges and billing
Paid services are billed according to the billing cycle shown at checkout or in the Client Area. You are responsible for paying invoices by their due date and for keeping a valid payment method available where recurring payment has been authorised.
Free services may be subject to different limits and may be changed, withdrawn or converted to a paid plan with reasonable notice where appropriate.
4. Renewals, cancellation and termination
Where a service renews automatically, it will continue until cancelled in accordance with the cancellation options available in the Client Area or through support. Where a choice is offered, cancellation may take effect immediately or at the end of the current billing period.
Amounts already paid are not automatically refundable unless required by law or expressly stated otherwise. We may suspend or terminate a service for non-payment, serious abuse, security risk or a material breach of these terms.
5. Customer responsibilities
You are responsible for the content, applications, DNS records, software and data you place on or configure through your services. You must keep software reasonably secure and up to date, and must not use the service in breach of our Acceptable Use Policy.
6. Backups and data
Unless a plan expressly states that managed backups are included, you should maintain your own independent backups of important websites, databases, configuration and other data. Any backup feature we provide is an additional resilience measure and should not be treated as your only copy.
7. DNS services
You are responsible for ensuring DNS records are accurate and appropriate for your intended use. DNS changes can take time to propagate because of caching and TTL values outside our direct control. We are not responsible for third-party registrar configuration or services operated outside NetNavi Cloud.
8. Availability and maintenance
We aim to provide reliable services but do not promise uninterrupted or error-free operation unless a specific service-level agreement says otherwise. Planned or emergency maintenance, network events, upstream-provider issues, attacks and circumstances outside our reasonable control may affect availability.
9. Support
Support covers reasonable assistance with NetNavi Cloud services and platform-related issues. It does not automatically include website development, application debugging, third-party software administration or work outside the scope of the purchased service.
10. Abuse and security
We may take reasonable action to protect customers, networks and third parties where a service appears compromised or is causing abuse. This may include temporary restriction, suspension, traffic filtering or other proportionate technical measures while an issue is investigated.
11. Liability
Nothing in these terms excludes liability that cannot lawfully be excluded. To the extent permitted by law, NetNavi Cloud is not responsible for indirect or consequential loss, loss of profit, loss of business, loss caused by customer configuration, or loss caused by third-party services outside our reasonable control.
Our total liability arising from a particular paid service will, to the extent permitted by law, normally be limited to the fees paid for that service during the 12 months immediately before the event giving rise to the claim.
12. Changes to these terms
We may update these terms to reflect changes to our services, suppliers, security requirements or applicable law. Material changes will be published on this page and, where appropriate, communicated to affected customers.
13. Governing law
Unless a separate written agreement states otherwise, these terms are governed by the laws of England and Wales and disputes will be subject to the courts having jurisdiction under applicable law.
